Welcome to Africa Safari Hunts! We invite you to use the Africa Safari Hunts website and all of it's available services, but please note that your invitation is subject to your acceptance of these terms of service. This document describes in detail your rights and our rights relating to the provision of The Service  (as defined below), so please review these terms carefully. 

This is an agreement between you and Africa Safari Hunts (with its affiliates, "Africa Safari Hunts" or "we"). Before using Africa Safari Hunts, please read these Terms of Service, including the Africa Safari Hunts Privacy Notice (collectively, this "Agreement"). By using Africa Safari Hunts you agree to the terms of this Agreement on behalf of yourself and all other persons who use Africa Safari Hunts under your account. If you do not accept the terms of this Agreement, then you may not use Africa Safari Hunts.

For the purpose of these Africa Safari Hunts Terms of Service:

"Africa Safari Hunts" means the AfricaSafariHunts.com website, which includes all digital content, software, support, and other related services.

“Africa Safari Hunts Interactions” means all information related to your use of Africa Safari Hunts, including your voice and other inputs, responses provided to you from Africa Safari Hunts, information we receive in connection with Third Party Services and Auxiliary Products you use, and information and content you provide or receive through Africa Safari Hunts.

"Software" means all software that we make available to you for use in connection with Africa Safari Hunts including, but not limited to, the africasfarihunts.com website.

"Third Party Service" means any other service or application provided by a third party that we make available to you for use on or through Africa Safari Hunts.

"User Generated Content"  means any material that is created by any person or company not affiliated with Africa Safari Hunts, including blogs, wikis, discussion posts, chats, tweets, podcasts, digital images, video, audio files, advertisements, and any other form of media generated and provided by users to Africa Safari Hunts or any of its Third Party Services or affiliates.

1. Africa Safari Hunts

1.1. Africa Safari Hunts. Africa Safari Hunts requires an internet connection to access and use Africa Safari Hunts. Some Africa Safari Hunts services may not be available in all areas and may require separate fees or subscriptions.

1.2 Use of the Software. You may use the Software only on AfricaSafariHunts.com or through approved Third Party Services.

1.3 Africa Safari Hunts Interactions. Africa Safari Hunts processes and retains your Africa Safari Hunts Interactions, such as any post, comment, image, and any other form of submission to provide, personalize, and improve our services. 2. User Generated Content.

2.1 User Generated Content Submissions

2.1.1 Any User Generated Content provided to Africa Safari Hunts, its Third Party Services, or its affiliates is provided at no cost to Africa Safari Hunts and is given without expectation of payment or credit.

2.1.2 You hereby provide Africa Safari Hunts with an irrevocable, sublicensable, worldwide, perpetual, royalty-free, and non-exclusive license to use any content that you submit, including but not limited to text, photographs, videos, drawings, or other media files.

2.1.3 You agree and understand that you are giving Africa Safari Hunts permission to publish, modify, reproduce, distribute, destroy, or otherwise utilize your User Generated Content for any purpose Africa Safari Hunts sees fit. You explicitly agree to waive all moral rights in your User Generated Content, whether or not such moral rights have been asserted anywhere in the world.

2.1.4 You warrant and agree that any User Generated Content that you submit to Africa Safari Hunts will not violate or infringe upon the rights of third parties, including patent, copyright, trademark, privacy, publicity, or other personal or proprietary rights. You warrant and agree that any User Generated Content you submit to Africa Safari Hunts will not contain defamatory material or any other unlawful material. Africa Safari Hunts retains the right to terminate your access to the Service and to delete your account without notice and in its absolute and sole discretion, including but not limited to for violating the rights of a third party or for defamation of a third party.

2.1.5 You agree and understand that it is your sole responsibility to backup any User Generated Content that you submit to Africa Safari Hunts.

2.1.6 You agree that if you provide any ideas, feedback, and/or proposals (“feedback”) to Africa Safari Hunts regarding Africa Safari Hunts or the associated services, such feedback is not confidential and not proprietary, and you authorize Africa Safari Hunts to use that feedback without restriction and without any compensation to You. Accordingly, you hereby grant to Africa Safari Hunts an irrevocable, sublicensable, worldwide, perpetual, royalty-free and nonexclusive license to use such feedback in any manner and for any purpose.

2.2 Objectionable Content
User Generated Content should not include content that is offensive, insensitive, upsetting, intended to disgust, in exceptionally poor taste, or just plain creepy. Examples of such content include:

2.2.1 Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups, particularly if the User Generated Content is likely to humiliate, intimidate, or harm a targeted individual or group. 

2.2.2 Realistic portrayals of people being killed, maimed, tortured, or abused, or content that encourages violence.

2.2.3 Portrayals of animals being killed, maimed, tortured, or abused outside of the scope of normal game hunting or in an illegal or unethical manor.

2.2.4 Depictions that encourage illegal or reckless use of weapons and dangerous objects, or facilitate the purchase of firearms or ammunition outside of legal channels or in an irresponsible manor.

2.2.5 Overtly sexual or pornographic material, defined by Webster’s Dictionary as “explicit descriptions or displays of sexual organs or activities intended to stimulate erotic rather than aesthetic or emotional feelings.” 

2.2.6 Inflammatory religious commentary or inaccurate or misleading quotations of religious texts.

2.3 Copyright Infringement and DMCA Policy

As we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe any Content violates your copyright, please see our Digital Millennium Copyright Act (“DMCA”) Policy and send us a notice.

3. Third Party Services; Third Party Products.

3.1 Third Party Services. If you use a Third Party Service, we may exchange related information with that service, such as information about your Auxiliary Products. Your use of any Third Party Service is subject to this Agreement and any third party terms applicable to such Third Party Service. These third party services have their own separate terms of service, which may be updated from time to time. If you do not accept the third party terms applicable to a Third Party Service, do not use that Third Party Service. When using a Third Party Service, you are responsible for any information you provide to the third party. Third Party Services may change or discontinue the services, functionality, or features of their Third Party Service at any time, without advanced notice. Africa Safari Hunts has no responsibility or liability for Third Party Services.

3.2 Third Party Products. Africa Safari Hunts includes access to and details about third party products and services that Africa Safari Hunts does not provide, manufacture, or develop. Africa Safari Hunts has no responsibility or liability for such third party products or services.

4. General

4.1 Information. The Software will provide Africa Safari Hunts with information about your use of the Software and your Africa Safari Hunts Interactions (such as device type, name, features, status, network connectivity, software performance, and location). This information may be stored on servers outside the country in which you live. We will handle any information we receive in accordance with the Africa Safari Hunts Privacy Notice.

4.2 Functionality; Content. We do not guarantee that Africa Safari Hunts or its functionality or content is accurate, reliable, always available, or complete. You may encounter content through Africa Safari Hunts that you find offensive, indecent, or objectionable. Africa Safari Hunts has no responsibility or liability for such content.

4.3 Changes to Africa Safari Hunts; Amendments. We may change, suspend, or discontinue Africa Safari Hunts, or any part of it, including any Third Party Services or Premium Features, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on the Africa Safari Hunts website. Your continued use of Africa Safari Hunts after the effective date of the revised Agreement constitutes your acceptance of the terms.

4.4 Geographic Restrictions. Africa Safari Hunts is operated in the United States. We may restrict access to Africa Safari Hunts or certain features from other locations at our sole discretion.

4.5 Termination. We may terminate your access to Africa Safari Hunts at our discretion without notice (except as may be required by applicable law). Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Africa Safari Hunts may immediately revoke your access to Africa Safari Hunts without refund of any fees. Africa Safari Hunts' failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

4.6 Disputes. Any dispute or claim arising from or relating to this Agreement or Africa Safari Hunts is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Africa Safari Hunts Terms of Service.

4.7 Disclaimer of Warranties and Limitation of Liability. Unless otherwise required by applicable law, in no event will our or our licensors' or our service providers' aggregate liability with respect to any claim arising from or relating to this Agreement or your use of Africa Safari Hunts exceed twenty dollars ($20).

4.8 Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
